In May 2024, the Foshan Chancheng District Court was informed of a case involving Feng Mou, who wanted to renovate a factory for a knitting business. However, he hired an unlicensed contractor to carry out the renovation. Three days into the work, the contractor suffered an electric shock and was electrocuted. The Chancheng Safety Supervision Bureau later issued an administrative penalty of 120,000 yuan, citing that Feng Mou had entrusted the renovation project to an individual without the necessary safety production qualifications or conditions, which led to a safety accident. Feng Mou refused to accept the penalty and filed an administrative lawsuit. After two trials, his appeal was denied.
In June of last year, Pingmou contracted a water, gas, and pipeline installation project to a company named Aliang, who claimed to be a qualified contractor. However, Aliang subcontracted part of the work to A Fang, a construction worker with no formal qualifications. On June 7th, during the third day of work, A Fang was electrocuted while operating a power drill inside the factory.
It was later discovered that Aliang held an electrician’s license, but it had expired. A Fang had no professional certification at all. On September 30th last year, the Chancheng Safety Supervision Bureau issued an administrative punishment decision against Feng Mou, stating that he had handed over the renovation project to an entity lacking proper safety conditions and qualifications, resulting in a serious safety incident. He was fined 100,000 yuan.
Pingmou also disputed the penalty and filed a lawsuit in the Chancheng Court on November 18th last year. The first instance ruling dismissed his claim, and in February this year, he appealed to the Foshan Intermediate Court.
The court acknowledged that the Safety Supervision Bureau had failed to submit the accident investigation report and approval documents within the required timeframe during the first trial, which was considered a procedural flaw. However, the court ruled that these materials only reflected internal procedures and did not affect Feng Mou's legal rights. Therefore, the procedural error did not amount to a legal violation.
