Ministry of Commerce: Midea will launch a double-reverse investigation on China's PV

On January 23, 2014, the U.S. Department of Commerce announced the initiation of anti-dumping and countervailing duty investigations into imported photovoltaic (PV) products from China. Additionally, it launched an anti-dumping investigation on PV products from Taiwan. This marked the second time since November 2011 that the U.S. had initiated a "double-countervailing" investigation against Chinese solar products, signaling continued trade tensions in the renewable energy sector. The scope of the investigation includes crystalline silicon photovoltaic cells, whether sold individually or as part of larger systems such as batteries, modules, laminates, panels, or building-integrated materials. However, thin-film photovoltaic cells made from materials like amorphous silicon, cadmium telluride, or copper indium gallium selenide are excluded. Also, solar cell products already subject to existing anti-dumping or countervailing measures are not included in this new probe. The products under scrutiny fall under several U.S. Customs tariff classifications, including 8501.61.0000, 8507.20.8030, 8507.20.8040, 8507.20.8060, 8507.20.8090, 8541.40.6020, 8541.40.6030, and 8501.31.8000. These classifications help identify the specific types of solar products targeted by the investigation. According to the standard U.S. investigation process, the U.S. International Trade Commission was expected to issue its preliminary determination around February 14, 2014. If the decision was favorable, the Department of Commerce would then proceed with its preliminary countervailing duty ruling by March 28, 2014, followed by a preliminary anti-dumping determination around April 11, 2014. This timeline highlighted the complexity and multi-step nature of the U.S. trade enforcement mechanism. This move by the U.S. government raised concerns among Chinese and Taiwanese manufacturers, who feared potential tariffs that could significantly impact their exports to the American market. The investigation underscored the growing geopolitical and economic competition in the global solar industry.
